Deering Conservation Commission
Minutes of the Meeting
December 1, 2003

The meeting was called to order at 7:35 PM by Chm. Cobbett .
In Attendance:
Ed Cobbett, Chm., Robert Garland , Michelle Johnson,
Keith Johnson, Gary Bono, Bev Yeaple , Clerk and Alternate. Absent: Steve Ainsworth, LeeSteffy Jenkins, Treas.

The Minutes of the Nov.3rd meeting were approved unanimously.EC/MJ

Treasurers Report:
1. The 2003 Budget and Expense report for October was reviewed .
2. The Invoice from the Contoocook and North Branch River Local Advisory Committee for dues was an error and will be handled by the Chairman.
3. The Notification from the Board of Selectmen -ie
"As of November 24, 2003, There is a freeze on all spending
Nothing is to be ordered, Per Board of Selectmen" was noted . There are no unexpected expenses left for the year for the commission.
The Commission is within its budget .
Communications:
1. Notice: Memo: To all Dept.Heads and Committee Heads . Re: Hazardous Mitigation Report . A Public Hearing Meeting on the Report . will be held on Dec 3, 2003 @ 7:00 PM- Town Hall . So noted.
2. Information packet from "REACH" -relative to discussion in Hopkinton , NH about the possible building by "BioEnergy" of a demolition and construction debris burning facility was reviewed .
3. ZBA . Agenda and Minutes of 10-22-03 Meeting were reviewed.
4. NHDES - Wetlands File # 2003-02397 Jonathon Dawson,
Campbell Cove Lane . # 229/24 . ³ Notice of Administrative Completeness -Minimum Impact Expedited Application ³ .-Reviewed.
5. ZBA- (a) Minutes of 11/23/03 Meeting
(b) Copy of letter from K. and J. Lassey to R.Todd - surveyor, relative to a possible conservation easement on their property at Deering Lake. (c) Application for Appeal - B.and R. Marion re- SD - Barnes Rd. This project is still under review and discussion by the ZBA.
6. Lakeside - NHLA , copy - October 2003 .
7. Hillsborough Cty. Cons. District. - re discontinuing soil overlays .
Action by HCCD so noted.

Old Business:
1. Update on :
a. Milfoil Warrant article - @ Town Meeting
The Chairman has received a copy for review.
b. Land Use Change Article - 100% of tax- request to the Conservation Fund is being written by Michelle Johnson.

2. Chm. Cobbett read the letter he has addressed to - The Fish and Game Dept., the Marine Patrol, all Bass Fishing Clubs, and the NHLA
re the concerns of the DCC in the spread of milfoil by inadequate cleaning of Club members boats, engines etc prior to entering the
Deering lake. - and all lakes and ponds around Deering.

3. Results of Public Hearing --C. Kelly junkyard .
The Selectmen are still waiting to do a full site investigation.
Selectwoman Johnson reported that there our concerns still about fencing and buffers, the monitoring of wells will be mandatory. Last date is Dec. 17th.

4. The Commission is still waiting for a complete report on NHDES # 2003- 01589 - Chm. Cobbett¹s inquiry re ATV trails - bank of Contoocook River and wetlands violation on the old RR bed .

5. Results of Loading Study - Casa - development on Old County Road.
See the report on the Town web site.  (under planning board section)

6. Report from Bev re "Rivers Management" meeting - Some material
relevant to the Planning Board given to Chm. Keith Johnson. Other material for review placed on file "River Management" for benefit of members on River Committees .

New Business:
1. Discussed : a Recommendation to do a "Loading Study" of the area around Deering Lake . Discussion - What constitutes a break in the State Law relative to surface water contamination. Water quality of the lake was discussed and what measures are necessary to maintain its quality .
There are grants available for study of the watershed .
There was agreement by those present on the need for a 100¹ buffer .

2. Conservation Easement Boundary Walks . All will be completed and reported by Dec. 31st.

3. Chm. Cobbett took thirty plus surface water test samples around the lake and the Town for pH and conductivity.

4. There was discussion re the proposal currently before the ZBA which involves the granting of a conservation easement on the property of Mr Lassey to justify the granting of a variance for an additional lot on a proposed subdivision by his abutter , Mr. Bernard Marion. The proposed Marion lot does not have the 150 feet of shoreland frontage required by the Zoning Ordinance. The lot would have 90 + or- feet of shoreland frontage
and the Conservation easement would have 60-70 feet of shoreline .
After much discussion, it was the consensus of the Commission members that the use of conservation land to provide justification for granting a variance for non-conforming lot creation was not an acceptable practice and sets a bad precedent relative to other non-conforming lots which abut conservation easement land .
It was requested that the Chairman write a letter to the ZBA outlining our position on this issue .
