Zoning Board of Adjustment

The Deering Zoning Board of Adjustment (ZBA) is a quasi-judicial body, which is tasked by state law with the responsibility of interpreting the provisions of the Town's Zoning Ordinance and deciding whether relief from provisions of the Ordinance is warranted in individual circumstances. It has been said that the ZBA is the “safety valve” of land use law, which allows “waiver of the strict letter of the zoning ordinance without sacrifice to its spirit and purpose.” In carrying out this role, the Board must carefully balance the constitutional property rights of citizens with the need of the Town as a whole to provide order in land use regulation.
